Job Summary

The Senior Director of Change Order Management, reporting to the Deputy Chief of Contract Services, will lead a diverse professional staff providing comprehensive Change Order (CO) analysis services in support of Capital Programs Support to deliver the Authority's multi-billion-dollar, five-year Capital Investment Plan (CIP). The Senior Director will work closely with the Director of Change Order Management and the Deputy Chief of Contract Services in determining the Authority's Change Order Group's process efficiency and effective objectives, as well as recommending MBTA-wide policy decisions regarding the contractor change management process. 

This role will develop guidelines and process changes that align with MBTA leadership's strategic capital construction plans. The Senior Director is the lead negotiator for complex, high-dollar and time-related overhead contract changes as delegated by the Deputy Chief, and will be responsible for enforcing MBTA, Federal Railroad Administration (FRA), and Federal Transportation Authority (FTA) compliance with construction contract change actions. 

The Senior Director will also monitor contractor compliance with false claims avoidance and statutory cost audit protocols. The Senior Director will work in partnership with functional leads of multiple MBTA departments needing to deliver the capital program. Duties will include, directing, and managing a highly talented, experienced, and matrixed technical team, managing contract consultant budgets and collaborating with other teams and departments on a wide range of program requirements and issues. 

Duties & Responsibilities

  • Manage the MBTA Capital Program Change Order group and work closely with Deputy Chiefs in determining the Authority's Capital Delivery objectives, as well as make or recommend all policy decisions regarding the contractor change management process.
  • Partner with Project executives, Chiefs and Deputy Chiefs in defining organizational goals for strategic changes in construction plans requiring Change Orders.
  • Liaise with the MBTA Capital Program Oversight Department to ensure that contractor change actions are integrated with e-Builder, the MBTA's Project Management Information System and FMIS. 
  • Oversee training and mentoring of project staff in the technical review, analysis, negotiations, and resolution of change order issues and problems.
  • Lead negotiations on multiple large construction changes, including resolving delay and construction change Cost Proposals while conforming to MBTA / FTA procurement policies and change pricing reasonableness protocols.   
  • Provide input and guidance to MBTA Project Managers for Work Directive Letters, Authorization Review Control Forms, and Amendment scope language. This includes developing order of magnitude independent cost estimates (ICE) for complex changes and reviewing submissions for accuracy and completeness. 
  • Acts as the main point of contact with senior contractor owners, CFOs & CEOs in negotiating on contract change actions, and exercises the authority to approve or renegotiate changes in costs within delegated authority and recommend higher level resolutions. 
  • Ensure accuracy and compliance of construction change order packages and work products with MBTA Standard Operating Procedures (SOPs), policies, and federal regulations. 
  • Oversee maintenance of eBuilder CO data such as a comprehensive electronic data log and central filing system for department Work Directives & Change Order records and supporting analytical documents.
  • Lead the procurement of CO support consultants and claims specialty contractors, ensuring that monthly payment and work submissions are being reviewed, accepted & paid in a timely manner.
  • Prepare and deliver complex presentations on changes and claims subjects, negotiated cost savings, and related capital program management topics.
  • Represent the MBTA externally as a subject matter expert in construction change orders and claims.
  • Communicate effectively with MBTA leadership, MBTA contractors, MBTA customers, MBTA employees and consultant vendors.  
  • Uphold the rights and interests of the Authority while building and maintaining an effective relationship with employees. 
  • Manage the workforce by ensuring fair and consistent application and strict adherence to the rules, regulations, collective bargaining agreements (if applicable) and policies of the Authority including the EEO, Anti-Discrimination and Anti-Harassment and Anti-Retaliation policies.
  • Perform all other duties and projects that may be assigned.
  • The Senior Director will lead the Capital Program Change Order team of over 15 professionals, including direct supervision of a Director and a Senior Change Order Manager.

Minimum Requirements & Qualifications

  • A Bachelor's Degree in Construction Management, Engineering, Architecture, Business Administration, Economics, or a related field from an accredited institution.
  • Ten (10) years of experience in construction contract management and/or contract administration including the preparation and review of change orders or claims for heavy civil construction and transit industry construction projects.
  • Seven (7) years related experience in a supervisory capacity. 
  • Effective organizational, analytical, confidentiality, multi-tasking, time management and interpersonal skills.
  • Experience in presentations, and excellent communication skills including reporting to senior executive leadership.
  • Experience utilizing estimating software applications.
  • Proficient in MS Word, Excel, and database applications.
  • Excellent customer service and conflict resolution skills. 
  • Ability to provide internal and external customers with courteous and professional experience. 

Substitutions Include

  • A high school diploma or GED with an additional seven (7) years of directly related experience substitutes for the bachelor's degree requirement. 
  • An associate's degree from an accredited institution and an additional three (3) years of directly related experience substitutes for the bachelor's degree requirement.
  • A master's degree in a related subject substitutes for two (2) years of general experience. 
  • A nationally recognized certification, or statewide/professional certification in a related field substitutes for one year of experience.

Preferences

  • A Master's Degree in Construction Management, Law or Public Administration from an accredited institution.
  • Construction change order experience in the public sector highway construction management or transit industry fields.  
  • Prior management experience with construction and professional services contract administration and professional change order technical, analytical and cost review staff.
